CHARLOTTE, N.C.--The man police say killed his pregnant co-worker at the Flying Biscuit Cafe will have to wait to see if he will face the death penalty.

Mark Cox was supposed to be in court for a Rule 24 hearing Thursday.  His lawyer postponed the hearing until May 3rd.

Detectives say Cox killed 25-year-old Danielle Watson and her unborn child.

Her body was found behind a dumpster near the Ballantyne restaurant.  Police arrested Cox in Fayetteville several days later.

He is currently in the Mecklenburg County Jail with no bond.
