KANNAPOLIS, N.C. -- The man responsible for murdering a 10-year-old boy may face the death penalty.

Eugene Mays, 39, will be appointed an attorney from the capital defender's office.

Mays was arrested by Gaston County police Monday on outstanding misdemeanor warrants for unrelated charges. He was transferred to Kannapolis on first-degree murder charges.

During a welfare check Sunday night, police forced their way into a residence and found the 10-year-old dead and a woman severely injured.

Mays will have a probable cause hearing on April 30.
