Father Charged In Murder of DWI Suspect Who Killed His Sons

HOUSTON, T.X.--Police have charged a man in Texas with murder after they say he fatally shot a suspected drunk driver that plowed into his sons while they were pushing their family's broken-down vehicle on a rural road. 

Investigators say thirty-one-year-old David Barajas and his two sons, 12-year-old David Barajas Jr. and 11-year-old Caleb Barajas, were only 150 feet from their house when a car crashed into them. 

The 12-year-old died at the scene and the 11-year-old died later at a local hospital.  Neighbors say they heard gunshots shortly after the accident. 

Police found 20-year-old Jose Banda dead inside his vehicle.  Investigators say he was shot in the head and his death has been ruled a homicide. 

Witnesses told police that Barajas went to his home shortly after the accident, returned to the scene with a gun and shot Banda, the suspected drunk driver. 

Barajas is being held on a $450,000 bond.
