CHARLOTTE, N.C.--No charges for a man who was holding a gun that police say went off and killed an Ardrey Kell student.

Jasmine Thar died in December 2011.  She and two other women were hit by a neighbor's stray bullet.

The DA has ruled that shooting an accident.  Investigators say the gun went off and the trigger was never pulled.

Jasmine Thar's family now plans to sue the gun's maker, Remington.  They had pushed for criminal charges for the neighbor because they felt the shooting was racially motivated.
