MARICOPA COUNTY,AZ--An Arizona man famous for getting pregnant after a sex change is in court fighting for custody of his kids.

Thomas Beattie claims his wife abused him in front of their three children, If the judge determines the marriage is same sex, a divorce won't be granted.

Same sex marriage isn't legal in Arizona.

Beattie appeared on Oprah explaining his life as a women, turned pregnant man.
