CHARLOTTE, NC — WCCB learned Monday that a Newton man charged with the murder of his girlfriend’s 17-month-old son will not face the death penalty if he’s convicted.  That’s the decision from the district attorney’s office.

Tyler Linebarger is charged with first-degree murder.  Police say Amber Estep left her son with Linebarger while she went to work on New Year’s Eve.  Linebarger called 911 saying the baby wasn’t breathing and was blue.

Doctors say the infant had internal injuries and other injuries in various stages of healing.
