Wes Kerrick Attorneys Want Case Thrown Out

Β CHARLOTTE, NC — The attorneys for a CMPD officer who shot and killed an unarmed man are asking the judge to throw out the case.

Wes Kerrick’s attorneys filed a motion today, saying the voluntary manslaughter charged should be dismissed, because blood evidence in the case has been destroyed. Β The motion claims the state did not make sure samples of Jonathan Ferrell’s blood were saved. Β The defense says they wanted the blood tested for specific drugs that weren’t tested during the autopsy, which came back clear.

Kerrick shot Ferrell 10 times in September of 2013, after he says Ferrell charged at him. Β Kerrick’s criminal trial is scheduled to begin in July. Β He entered a not guilty plea last month, and remains on unpaid leave.
