LOS ANGELES (AP) β€” A judge is scheduled to rule Monday on whether Terrence Howard can overturn a divorce settlement that entitles his ex-wife to a share of his earnings, including from the hit show “Empire.”

Los Angeles Superior Court Judge Thomas Trent Lewis has ordered attorneys for Howard and ex-wife Michelle Ghent to come to his courtroom Monday morning where the ruling will be announced.

The Oscar-nominated actor is not required to attend.

Howard has accused Ghent of blackmailing him over private audio and video of him dancing naked in a bathroom to sign the divorce settlement. The pair was married for a year before Ghent filed for divorce in January 2011.

Ghent’s lawyers have said she denied extorting the actor in a deposition. She was not allowed to testify at a recent hearing.
