No Timetable for Decision on Wes Kerrick Retrial

CHARLOTTE, NC —Β There’s no timetable set on when the state could decide whether or not to retry CMPD Officer Wes Kerrick in the shooting death of Jonathan Ferrell. Β A judge declared a mistrial on Friday.

Prosecutors will take into account whether they think they could win a new trial. Β The jury deadlocked 8 to 4 on a verdict: the majority voting not-guilty on manslaughter charges.

WCCB Charlotte legal contributor John Snyder says a new trial will take time to come together and could include several changes.

“Everything’s new. A brand new jury will be selected. So we will have that length of time and trial. It may be a different judge. Judge Ervin may keep the case, but most likely not,” said Snyder.

If the state decides to retry Kerrick, it could be a year or longer before we see another trial. Β The case would go to the back of the line for cases in Mecklenburg County.
