The case against CMPD Officer Wes Kerrick is officially over. Β North Carolina Attorney General Roy Cooper willΒ notΒ retry Kerrick in the 2013 shooting death of Jonathan Ferrell, saying a second trial would yield the same result.

The decision comes just one week after the judge declared a mistrial in the case. Β The jury was deadlocked, with eight jurors voting to acquit Kerrick, and four voting to convict him.

“While our prosecutors believe that the elements of the crime of voluntary manslaughter were met by the facts in the law in this case, only four members in the jury agreed with us,” said Cooper.

Prosecutors made their decision after speaking with jurors from the original trial. Β The senior deputy Attorney General says a dismissal of the voluntary manslaughter chargeΒ against Kerrick will be submitted, closing the case and making Wes Kerrick a free man.
