Mistrial Declared In NASCAR Driver Mike Wallace Assault Case

UPDATE:  A judge has declared a mistrial in the assault casing involving NASCAR driver Mike Wallace.  Judge Ronald Chapman says two witnesses violated his sequestration order.  The two witnesses are now being held in contempt of court.

CHARLOTTE, NC– “Next thing I knew I hurt severely bad and then I don’t remember anything until I woke up,” said Mike Wallace in court.

“I was hurting my front tooth was knocked out, I reached up and there was blood all over my face,” said Wallace.

Prosecutors say Nathan Lucas and Randolph Mangun assaulted Wallace. Paul Lucas also charged with assault, accused of attacking Wallace’s daughter Lindsey and her husband Thomas Van Wingerden.

” It was my daughter my loving daughter somebody beat on her somebody did something to her to hurt her so it hurt and the problem was I wasn’t able to protect her,” said Wallace.

The state’s first witness, Nicki Melton says she watched the fight and described Wallace’s condition when she tried to help him.

“He was unconscious there was no movement his eyes were not open and there was blood everywhere coming out of his nose, coming out of his mouth, his lip was split open,” said Melton.

CMPD officer Brian Kursak testified he was working off duty but responded to the scene and authorized the arrest of all three defendants.

In cross examination defense attorney’s asked Wallace about how many drinks he had that night, medication he took that day, and about witness accounts that he was cursing and uncooperative with medics.. which Wallace denies.

The state is expected to call Wallace’s daughter Lindsey Van Winderden to the stand when court resumes Wednesday then the defense says they have eight or ten witnesses to call when they present their case.
