Unfortunately, in the real world, laws don’t make it that easy.
“A client contacted me after we closed and we had found out that there had been a death on the property, but it had occurred over 10 years ago, so there was no recourse,” said Leslie Piper of Realtor.com.
In real estate terms, a potentially haunted house is known as a “stigmatized property.” Disclosure laws vary state to state.
Most of these laws require sellers to list any physical defects, but when it comes to emotional defects, it’s buyer beware.
However, in one famous New York case commonly known as the “ghostbusters ruling,” a couple was able to get their money back.
The court found that whether or not ghosts are real, the fact that the house had been widely reported as haunted affected its value.
