Ruling Delayed On CMPD Body Cam Release For Officer Involved Shooting

CHARLOTTE, NC– “She called the police for help and this happens, he died after that,” said Olesya Mosiuk’s fiancé, Eugene Conde.

The family of Yaroslav Mosiuk spoke for the first time since he was shot by CMPD officer Brian Walsh. Family says they were expecting the judge to release the police body cam video but it was put on hold.

“It’s disappointing because it happened in March now we’re in summertime and we still have no word nothing from them,” said Conde.

Mosiuk’s sister Olesya called police telling dispatchers her brother was acting strange and she was scared he might hurt himself. CMPD says officer Brian Walsh perceived a threat after seeing Mosiuk with a hunting rifle so the officer fired. Family attorney Lauren Newton says they filed the petition for the video to be released but CMPD attorney’s say it wasn’t received in time.

“The question is why in a mental health call was deadly force used and that’s the answer the family is seeking,” said attorney, Lauren Newton with Charles Monnett & Associates.

Safe Coalition NC also hand delivered a request for the video release and was told it also did not arrive at CMPD in time.

“This was the reason we were fighting against HB972, it makes it very hard and cumbersome for people to figure out how to get video which we believe should be public record to start with,” said Robert Dawkins with Safe Coalition NC.

The family says they believe the video shows a different story than what police say happened.

“Why, how it happens when you call police and you know they going to help you but first thing they shoot him in the back,” said Conde.
