Mt. Holly Doctor Accused Of Trading Drugs For Sex, Filing False Insurance Claims

MT. HOLLY, NC — The owner and operator of Mt. Holly Family Practice, Inc. is accused of giving drugs to female patients in exchange for sex.

According to court documents, Dr. Michael Alson Smith, of Gastonia, allegedly gave prescription drugs to at least seven female patients between January and October of 2017 after soliciting them for sexual acts. The alleged acts included unwanted touching, oral, vaginal, and anal sex.

In the documents, several victims seeking treatment for pain management and/or addiction describe instances where they were asked to engage in a variety of sexual acts before receiving treatment and prescriptions from Smith.

According to one victim, she and Smith had oral sex while her three-year-old daughter was in the room on one occasion, and then oral and vaginal sex while her three-month-old son was in the room on another.

One victim even claims that Smith threatened to stop treating her if she refused to have sex with him.

In addition to trading prescriptions for sex, the documents also say that Smith filed false claims to, and received payments from, North Carolina Medicaid and Medicare. The false claims were allegedly submitted for non-existent medical services during the office visits in which he would have sex with the patients.

Smith now faces multiple charges related to drug distribution, health care fraud, and aggravated identity theft.
