Police: Two Juveniles Arrested And Charged In Fatal Hit And Run After Street Racing

CHARLOTTE, N.C. – CMPD is investigating a hit and run crash on Albemarle Road that resulted in one driver’s death, according to a news release.

The release states that on July 28, officers responded to a motor vehicle crash that involved two vehicles on Albemarle Road. Upon arrival, officers say they found a 2011 Toyota Camry with damage on the passenger side and a 2006 Nissan 350z with front-end damage.

The driver and passenger of the Toyota were transported to the hospital and the driver, 81-year-old Robert Birch, was pronounced dead at the hospital. A 79-year-old passenger in the vehicle suffered serious injuries, according to a police report.

A preliminary investigation claims that the Nissan was racing a 2012 Scion passenger vehicle and the Toyota was making a U-turn, resulting in being struck by the Nissan.

The driver and passenger of the Nissan abandoned the vehicle and left the scene with the Scion.

Officers say they found the Scion and took both of the drivers, who are juveniles, in for an interview and at the conclusion charged them as adults with:

  • Felony hit and run/death
  • Spontaneous Street Racing
  • No operator’s license
