CHARLOTTE, N.C. — Mecklenburg County District Attorney Spencer B. Merriweather said he sent a request the to SBI to investigate Sheriff Garry McFadden after a petition for removal was filed.

Merriweather said its extremely rare for District Attorneys to grant the approval of removal petitions when it involves an elected official.
On Sunday, January 4th, five Mecklenburg County electors submitted the petition of removal on a number of grounds, according to a news release.
Merriweather said he will decide if approving the removal request will be granted once he gets the findings from the SBI’s investigation.
The removal petition claims Sheriff McFadden should be removed from office on the following grounds:
- For willful or habitual neglect or refusal to perform the duties of his office
- For willful misconduct or maladministration in office
- For corruption
- For extortion
DA Merriweather requested the SBI to also look into the following alleged criminal violations based on his review of the petition:
- State Campaign Finance Violations (use of official resources and labor in furtherance of political campaign)
- Hatch Act Violations
- Extortion
- Bribery, Economic Threats Made To Influence Legislation
