A Federal Appeals Court tosses out a Charlotte man’s racketeering convictions because his lawyer slept through his trial.

The judges said that Nikita V. Mackey’s sleepiness deprived Nicholas Ragin his Constitutional right to a lawyer.

Ragin was part of a prostitution sting involving runaways in Charlotte.

He was sentenced to 30 years to prison in 2006.
