CHARLOTTE, NC — WCCB learned Monday that a Newton man charged with the murder of his girlfriend’s 17-month-old son will not face the death penalty if he’s convicted. Β That’s the decision from the district attorney’s office.

Tyler Linebarger is charged with first-degree murder. Β Police say Amber Estep left her son with Linebarger while she went to work on New Year’s Eve. Β Linebarger called 911 saying the baby wasn’t breathing and was blue.

Doctors say the infant had internal injuries and other injuries in various stages of healing.
