Legal Loophole Could Let NC Rapists Off The Hook
Charlotte, NC — A legal loophole in North Carolina could get rapists off the hook.
Some lawmakers are trying to change that.
Right now, if you consent to sex and change your mind during the act, the other person does not have to stop.
a 1979 Supreme Court case found a man not guilty of rape when a woman says he became violent and said stop.
Attorney Jamie Filliben with SeiferFlatow Law Firm calls it unbelievable.
“The way our law stands, women don’t have the right to withdraw consent after giving it,” said Filliben. “This bill would actually be a win for women’s rights and really put on our law books what everybody should know in their hearts.
North Carolina in the only state with such a law.
Senator Jeff Jackson of Mecklenburg County sponsors Senate Bill 553 that gives a person power to say no after sex is initiated.
