Mooresville Homeowners Find Themselves On The Other Side Of The Fence With HOA
MOORESEVILLE, NC — Adam Flick doesn’t like his backyard fence’s new look. Recently, he had to take every other board off the fence for it to be compliant with the Bridgeport Community HOA rules.
Flick says he was recently told by the HOA the fence he built within the last year didn’t meet the community standards which states that fences must be 50% transparent.
“It’s just kind of the last straw,” said Flick.
Flick decided to sell his home after the HOA informed him of his violation.
“In order to put our house on the market, we had to take every other board down and get in compliance.” explained Flick
Flick says he, his next-door neighbor and Michelle Barker are the only ones facing discipline.
“I’m not sure why it’s being selectively enforced in the neighborhood,” said Barker.
Barker believes her fence is in compliance with the rule. She received a letter nearly two weeks ago stating she must take the fence down or be fined $50 per day until it is.
“There’s other homes in the neighborhood that have privacy fences that are clearly not compliant,” said former Bridgeport Community HOA President, Greg Smith.
Smith resigned in October.
“I resigned because of conflict in the neighborhood over fences. Selective enforcement,” Smith explained.
There are more than 14,000 HOA communities in North Carolina. State representative Laura Budd is part of a committee to create rules and regulations for HOAs.
“To make sure that we don’t have any outliers, favoritism, not enforcing restrictive covenants against certain neighbors, but enforcing it against others, things of that nature, ” said Rep. Budd.
Association Management Group manages the Bridgeport Community HOA. The lawyer representing AMG says he is looking into the issue and that AMG has no decision making power within the Bridgeport Community HOA.
