The incident happened on February 24th at a Charlotte Checkers game. A father, his 11-year-old son and his son’s 12-year-old friend were in the bathroom when the witness saw Cutler place a “GoPro” like device under the 11-year-old’s stall from the adjacent bathroom stall.

When the father confronted him, Cutler denied it and walked away. The incident was reported to security.

Following a lengthy investigation, authorities conducted a search warrant at Cutler’s home. Police said multiple electronic devices were seized, including a key fob recording device. Officials said this device was the one used during the crime.

Investigators reviewed the footage on the device and found seven separate videos of minors using the bathroom.

Police said all the videos were recorded on the same day at Bojangles Coliseum.

Cutler was facing the following charges from the incident:

  • Peeping using a photographic imaging device, 4 counts
  • Peeping while possessing a device capable of creating a photographic image, 3 counts
  • Possessing a photographic image obtained in violation of the peeping statue, 7 counts

Cutler had a criminal history of being a sex offender, dating back to 1999 when he was convicted of indecent liberties with a child. Additionally in 2008, Cutler asked a woman if he could photograph her son, officials said.

He was removed from the registry in 2011.
