UPDATE: State prosecutors announced Tuesday that they will not seek the death penalty against Rodney Ball for the alleged murder of Benny Daniels.
Officials say Ball does still face the possibility of life in prison.

CATAWBA COUNTY, NC — State prosecutors announced Tuesday that they will not be seeking the death penalty in the murder case against Thomas Ball.
Thomas Ball, 38, of Hickory, is will still face the possibility of life in prison, according to prosecutors. Ball’s brother, 27-year-old Rodney Ball of Cedar Bluff, VA., also face a murder charged for his involvement in the alleged killing of Benny Daniels, 78, of Long View.
According to officials, the Ball brothers are accused of killing Daniels after his body was found in a shallow grave on his property on October 12th. Daniels had been missing since October 8th, according to reports.
Thomas and Rodney were both arrested and charged with in connection to the murder and concealment of Daniels’ body.
