Lawsuit Filed In Deadly 2017 Officer-Involved Shooting

CHARLOTTE, NC — A lawsuit has been filed against the City of Charlotte and two CMPD officers in connection to the deadly 2017 officer-involved shooting of 29-year-old Rubin Galindo.

The lawsuit was filed Wednesday afternoon on behalf of Galindo and his girlfriend, and mother of his then newborn daughter, Azucena Zamorano Aleman. Zamorano was inside the apartment when Galindo was shot and killed by CMPD officers on September 6, 2017.

According to the lawsuit, Officers David Guerra and Courtney Suggs are being sued both individually and officially for negligence in both the “wrongful death of Decedant (Galindo)” and “infliction of emotional distress as to Zamorano,” as well as their “individual capacity under state law for assault and battery for shooting and killing Decedent.”

The lawsuit claims the City of Charlotte also “bears legal responsibility for acts and omissions of the CMPD and its police officers that occur in the course of any officer’s employment as a CMPD police officer and agent of the City.”

In November of 2017, the Mecklenburg County District Attorney Andrew Murray announced charges would not be filed against the officers involved in the case.
