Man shot by police during traffic stop in south Charlotte is out of the hospital and in jail

UPDATE 2/20/25:

CHARLOTTE, NC – A man who was shot by police in south Charlotte is out of the hospital and in jail.

The shooting happened following a traffic stop on February 11, 2025.

Police say officers perceived 21-year-old Erik Hernandez to be an imminent deadly threat and shot him.

Hernandez is charged with attempted murder on a law enforcement officer and assault with a deadly weapon with intent to kill.

CMPD says the officers who fired their guns are:

Officer Ryan Alberts assigned to Steele Creek Division. Officer Alberts began with CMPD on Oct. 25, 2021.
Officer Ellis Wilcox assigned to Steele Creek Division. Officer Wilcox began with CMPD on Oct. 25, 2021.
Officer Lucas Jayne assigned to Steele Creek Division. Officer Jayne began with CMPD on Jan. 17, 2023.

CHARLOTTE, NC – Charlotte-Mecklenburg police are investigating a shooting during a traffic stop in south Charlotte.

CMPD says the shooting happened near the QT gas station at the intersection of East Arrowood Road, around 2 a.m. Tuesday.

Officers tried to pull the man over several times throughout the night and when he did pull over, he got out of his vehicle.

”The subject did exit the vehicle and at that time officers perceived an imminent deadly threat,” a department spokesperson said. That’s when an officer fired a gun.

The subject was transported to a nearby hospital with life-threatening injuries. A firearm was also recovered on scene.

No officers were struck with gunfire, but several were transported to a nearby hospital. The officers involved have been placed on paid administrative leave pending the outcome of the investigation per standard protocol.
