Man Accused Of Killing Shelby Police Officer Waives Extradition

SHELBY, N.C. — Irving Fenner Jr., the man accused of killing Shelby Police Officer Tim Brackeen, has waived extradition.

He made an appearance in court last week in Rhode Island where he did not waive extradition. A judge denied his bond.

However, Fenner waived extradition Thursday.  There is no timetable on when he will return to Shelby to face murder charges.

Fenner is accused of shooting Brackeen in the chest while he was attempting to serve a warrant in Shelby over the weekend.  Brackeen died from his injuries Monday.

Sources tell WCCB the District Attorney plans on seeking the death penalty against Fenner.

Fenner was arrested in Rhode Island early Wednesday morning.  Fenner was treated at a hospital for a gunshot wound that occurred in Shelby, according to police.

Investigators say Fenner was shot on the left side of his stomach.  Doctors decided not to remove the bullet and it remains lodged behind his ribcage, according to police.

Police have also arrested Deitra Morris, Casey Fenner, Jolisa Peeler and Ashley Hamrick in this case.  Morris, Fenner and Peeler were all charged with accessory to murder, after the fact.  Hamrick was charged with harboring a fugitive.

Brackeen’s funeral will be held on Friday at 3pm at Keeter Stadium, 230 E. Dixon Blvd in Shelby.  A pubic visitation will be held on Thursday, September 15th at Bethel Baptist Church from 5-9pm.
